Los Angeles Rideshare Accident Lawyer
Helping Uber & Lyft Passengers Get Compensation for Injuries
Everyone in Los Angeles seems to use a ridesharing service like Uber or Lyft. While these services are convenient, they can be dangerous.
Rideshare drivers are constantly on the move and are often distracted by their GPS, rideshare app, or passengers. This can easily lead to a severe crash. In addition, many Uber and Lyft drivers are inexperienced and don’t know how to operate a vehicle safely.
If you have been injured in a rideshare accident in Los Angeles, you can file an injury claim and seek compensation for your medical bills, lost wages, and pain and suffering. However, these cases are often very complicated.
You must first determine who is liable for your injuries. Is it the rideshare driver? The rideshare company? Or is it another motorist on the road? Then, you must prove that the liable party’s negligence caused the crash. Finally, you must negotiate a settlement with the liable party’s insurer.
Our Los Angeles rideshare accident attorneys at Wisner Baum are here to help. We have extensive experience handling complex auto accident cases and will fight to get you the compensation you deserve. Let us handle the legal side of things while you focus on what is most important: recovering from your injuries.

Who is Liable for a Rideshare Accident?
After a rideshare accident, it is essential to determine who is liable for your injuries. This will help you determine where to file your claim and what damages you are entitled to. In most cases, the liable party is the rideshare driver. However, there are situations where the rideshare company or a third party is liable for your injuries.
Rideshare Driver Is Liable
In most cases, the rideshare driver is liable for your injuries. Rideshare drivers are independent contractors, meaning they are not Uber or Lyft employees. This means that Uber and Lyft are not liable for any injuries caused by their drivers.
However, rideshare drivers must carry their auto insurance policy with a minimum of $1 million in liability coverage. If the driver’s insurance policy is not enough to cover your damages, you may be able to file a claim with your insurance company.
Rideshare Company Is Liable
There are situations where the rideshare company is liable for your injuries. Uber and Lyft are required by California law to carry a $1 million minimum liability insurance policy that covers all accidents caused by their drivers.
This policy only applies if the driver was logged into the rideshare app and was either picking up a passenger or was on the way to pick up a passenger. The policy does not apply if the driver was not logged into the app or was not on the way to pick up a passenger.
For example, let’s say that a Lyft driver is on the way to pick up a passenger when he crashes into your car. If the driver’s auto insurance policy does not cover your damages, you can file a claim with Lyft’s $1 million liability insurance policy.
However, let’s say the driver was not logged into the app and was not on the way to pick up a passenger. In this case, Lyft’s insurance policy would not apply, and you would need to file a claim with the driver’s insurance company.
A Third Party Is Liable
There are also situations where another motorist is liable for your injuries. For example, let’s say that you are a passenger in an Uber when another driver runs a red light and crashes into the Uber. In this case, the other driver would be liable for your injuries. You must file a claim with the other driver’s insurance company.
